Wildly Ready Australia offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc., who provide us with the online e-commerce platform that allows us to sell our products and services to you.

Section 1 - Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or country of residence. You may not use our products for any illegal or unauthorised purpose, nor may you violate any laws in your jurisdiction. A breach or violation of any of the Terms will result in immediate termination of your Services.

Section 2 - General Conditions

We reserve the right to refuse service to anyone for any reason at any time. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission by us.

Section 3 - Accuracy, Completeness, and Timeliness of Information

We are not responsible if information made available on this site is not accurate, complete, or current. We reserve the right to modify the contents of this site at any time.

Section 4 - Modifications to the Service and Prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service without notice. We shall not be liable to you or any third-party for any modification, price change, suspension, or discontinuance of the Service.

Note for UK customers: All prices displayed include any applicable taxes and mandatory charges. We do not engage in drip pricing — the price you see is the total price you pay, in compliance with the UK Digital Markets, Competition and Consumers Act 2024 (DMCCA).

Section 5 - Products or Services

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colours and images of our products. We cannot guarantee that your device's display of any colour will be accurate. We reserve the right to limit sales of our products to any person, geographic region, or jurisdiction.

Section 6 - Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email address provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

Section 7 - Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties or conditions of any kind. Any use by you of optional tools offered through the site is entirely at your own risk.

Section 8 - Third-Party

Links Certain content, products, and services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. We are not liable for any harm or damages related to the purchase or use of goods, services, or content from third-party websites.

Section 9 - User Comments, Feedback, and Other Submissions

If you send creative ideas, suggestions, or other materials, you agree that we may, at any time, without restriction, use such comments in any medium. We are under no obligation to maintain any comments in confidence or pay compensation for any comments.

We may monitor, edit, or remove content that we determine in our sole discretion to be unlawful, offensive, or otherwise objectionable.

Note regarding reviews: In compliance with the UK Digital Markets, Competition and Consumers Act 2024 (DMCCA) and Australian Consumer Law, all customer reviews published on our site reflect genuine verified purchases. We do not commission, publish, or permit fake or misleading reviews.

Section 10 - Personal Information

Your submission of personal information through the store is governed by our Privacy Policy.

For customers in the European Union or United Kingdom: The processing of your personal data is governed by the General Data Protection Regulation (GDPR) and UK GDPR respectively. You have the right to access, correct, delete, and transfer your personal data. We will respond to all data access requests within 30 days. Please refer to our Privacy Policy for full details of how we collect, use, store, and protect your personal data and your rights under applicable law.

For California residents: Under the California Consumer Privacy Act (CCPA), you have the right to know what personal data we collect, request deletion of your data, and opt out of the sale of your personal information. We do not sell personal information to third parties. Please refer to our Privacy Policy for full details.

Section 11 - Errors, Inaccuracies, and Omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors and cancel orders if any information is inaccurate at any time without prior notice.

Section 12 - Prohibited Uses

In addition to other prohibitions as set forth in these Terms, you are prohibited from using the site or its content for any unlawful purpose; to violate any international, federal, or local laws; to infringe upon intellectual property rights; to harass, discriminate, or harm others; to submit false or misleading information; to upload malicious code; to collect personal information of others without consent; or to interfere with the security features of the Service.

Section 13 - Disclaimer of Warranties; Limitation of Liability

We do not guarantee that your use of our service will be uninterrupted, timely, secure, or error-free. The service and all products delivered to you through the service are provided 'as is' and 'as available' without any representation, warranties, or conditions of any kind.

In no case shall Wildly Ready Australia, our directors, officers, employees, affiliates, agents, contractors, suppliers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the service or any products procured using the service.

Nothing in these Terms limits or excludes any rights you have as a consumer under applicable law in your country of residence, including mandatory statutory rights that cannot be waived by contract.

Section 14 - Indemnification

You agree to indemnify, defend, and hold harmless Wildly Ready Australia and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.

Section 15 - Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, without affecting the validity and enforceability of any other remaining provisions.

Section 16 - Termination

These Terms of Service are effective unless and until terminated by either you or us. We may terminate this agreement at any time if you fail to comply with any term or provision of these Terms of Service.

Section 17 - Entire Agreement

These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements between you and us.

Section 18 - Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Australia, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence. Customers in the EU and UK retain all statutory rights afforded to them under applicable local consumer protection law, which these Terms do not override.

Section 19 - EU & UK Consumer Rights

If you are located in the European Union, you have a statutory right to cancel your order within 14 days of receiving your goods without providing a reason, in accordance with the EU Consumer Rights Directive (2011/83/EU). If you are located in the United Kingdom, the same 14-day cancellation right applies under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

To exercise this right, please notify us at help@wildlyready.com.au within 14 days of receiving your order. Items must be returned in their original condition within 14 days of notifying us. Return shipping costs are your responsibility unless the item is faulty or incorrect.

Please note: This statutory cancellation right applies regardless of whether an item was purchased at full price or during a promotional event, as required by applicable EU and UK law.

EU Online Dispute Resolution: The European Commission provides an Online Dispute Resolution platform for consumers at https://ec.europa.eu/consumers/odr. We are not obligated to participate in dispute resolution before a consumer arbitration body, but you are free to use this platform.

Section 20 - Changes to Terms of Service We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates to our website. Your continued use of or access to our website following the posting of any changes constitutes acceptance of those changes.
